1 Appellant, Richard Escobedo, hereinafter referred to as defendant, was charged, tried and convicted in the District Court, Comanche County, Case No. CRF-73-605, for the offense of Unlawful Delivery of Marihuana in violation of 63 O.S. 1971 ? 2-401 [63-2-401], _ B-2. His punishment was fixed at a term of three (3) years imprisonment and a fine in the amount of Three Thousand ($3,000.00) Dollars was assessed. From this judgment and sentence, a timely appeal has been perfected to this Court.
